New York City Department of Buildings, with an annual Place of Assembly permit from the Fire Department of the City of New York
DOB issues the Place of Assembly Certificate of Operation and performs the first inspection; FDNY then issues a permit that is renewed annually on the result of its own inspection. The legal occupancy lives on those two documents. A venue can show you the number; it cannot set it and cannot raise it for your date.
Ask instead Ask to see the current PACO and the FDNY place-of-assembly permit, and read the occupancy and expiry off the certificates rather than off a capacity chart.
